  6. The lack of a damage report does not deprive the Consumer of their statutory rights.

  7. In the event of damage to the Product, the Customer should contact the Seller at magneticmobel@gmail.com, providing a description of the problem and – if possible – photographic documentation.

§ 8. Right of withdrawal from the contract

  1. A Consumer concluding a distance contract generally has the right to withdraw from the contract without giving a reason within 14 days.

  2. The period generally begins from the day the Consumer or a third party indicated by them, other than the carrier, takes possession of the Product.

  3. To exercise the right of withdrawal, the Consumer should inform the Seller of their decision by means of an unequivocal statement.

The statement can be sent to:

Magnetic Mobel Sp. z o.o.
ul. Przemysłowa 1
Kraków, Poland

or electronically:

magneticmobel@gmail.com

  1. The Consumer may use the contract withdrawal form, but it is not obligatory.

  3. The refund of due payments takes place in accordance with the deadlines and rules resulting from applicable regulations.

§ 9. Products made to individual order

  1. The right to withdraw from the contract does not apply to the Consumer in cases specified by applicable regulations, in particular in relation to a contract the subject of which is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy their individualized needs.

  2. This exclusion may apply in particular to table legs and bases made according to the Customer's individual parameters, e.g., non-standard dimensions, construction, or other individual specifications.

  3. The mere fact that Product production begins only after an Order is placed does not automatically result in the Consumer losing the right to withdraw from the contract.

  4. If the Product is a personalized Product, information about the lack of the right to withdraw from the contract will be provided to the Customer before placing the Order.

§ 10. Complaints

  1. The Seller is liable to the Consumer for the Product's conformity with the contract in accordance with applicable regulations.

  • name of the complained Product,

  • description of the problem found,

  • photographic documentation, if the nature of the problem allows it.

  1. The absence of any of the above elements does not automatically result in the rejection of the complaint.

  2. Consumer complaints are handled within the time limits resulting from applicable regulations.

  3. In the event of non-conformity of the Product with the contract, the Consumer is entitled to the rights provided by applicable regulations.

§ 11. Product properties

  2. Slight differences in the structure or shade of the surface may occur between individual batches of Products due to material properties and the production process.

  3. The provisions of this paragraph do not limit the Consumer's rights resulting from applicable regulations regarding product conformity with the contract.

§ 12. Sales to entrepreneurs

  1. The Store also sells to entrepreneurs.

  2. The Entrepreneur should check the condition of the shipment as soon as possible after receiving it and inform the Seller of any damage or irregularities found.

§ 13. Out-of-court dispute resolution methods

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims on the terms provided for by applicable regulations.
